Breaking! It now emerges that Shia LaBeouf may not have been completely at fault for his DUI accident: "L.A. County Sheriff's Department spokesman Steve Whitmore said the investigation suggests that another driver may have run a red light, hitting LaBeouf's truck. That driver was cited at the scene for running a red light." Do you suddenly find yourselves confused about how to feel? If a drunk driver gets hit by a red-light-runner at Fountain and LaBrea, flipping over his three-ton truck in the process and necessitating hand surgery, does it make a sound? Shia is still a jerk, and anyone can sue anyone. In order to collect one jerk has to be more "at fault" than the other. This sounds like a 50%- 50% at fault situation, so it would be a draw. Shia would still be guilty of his DUI, so hopefully, the courts can keep him away from the wheel for awhile.

"Not completely at fault" does not mean he won't get sued by the other driver. I've seen similar situations where the other driver was at fault, but the one who was DUI was successfully sued.

Of course, if Shia had not been impaired, he might have been able to react in time to avoid the impact....
The good thing for him is that it lessens the possibility that there will be a civil lawsuit.
It's something like the Florida case where former Yankees player Jim Leyritz hit and killed a woman when he ran a red light. TUrns out that, while he was drunk, the woman that died had an even higher blood alcohol level.

ironically this very situation happened to my father (as he told it anyway), although it certainly doesn't mean i let him off the hook for driving whilst intoxicated.
